Terms of Service Welcome to Fetchr, a matchmaking platform operated by FunRealm. These Terms of Service (the "Terms") govern your use of the Fetchr platform and services. Definitions 1.1 Service Fetchr provides a platform where users can post and accept tasks, including but not limited to home services, repairs, deliveries, etc. 1.2 User Users are individuals or entities who access Fetchr to post tasks ("Task Posters") or accept tasks ("Task Executors"). 1.3 Platform Role Fetchr is solely a matchmaking platform. We do not verify the accuracy of task information or monitor user interactions. All agreements and outcomes are the sole responsibility of the involved parties. 2. User Responsibilities 2.1 Information Verification Users are solely responsible for verifying the accuracy, authenticity, and reliability of the information provided by other users on the platform. Fetchr does not guarantee the truthfulness or reliability of any task description or user profile. 2.2 Independent Judgment Users must exercise independent judgment when posting or accepting tasks and ensure compliance with applicable laws and regulations. 2.3 Liability for Actions All activities and interactions initiated through Fetchr are conducted at the user’s own risk. The platform is not liable for disputes, losses, or damages arising from user actions. 3. Platform Use 3.1 Task Posting and Acceptance Users may post tasks or accept tasks via Fetchr. Task Posters and Executors must agree on task details and payments independently. Fetchr does not mediate disputes between users. 3.2 Fees and Payments Fetchr collects a commission from task payments processed through the platform. Payment details, including rates and service charges, are displayed within the app. 4. User Conduct 4.1 Prohibited Activities Users are prohibited from: Posting fraudulent or misleading tasks. Engaging in illegal or unethical activities. Violating the rights of other users or third parties. 4.2 Consequences of Misconduct Fetchr reserves the right to suspend or terminate accounts violating these Terms. 5. Role of Fetchr 5.1 Matchmaking Service Fetchr acts solely as a matchmaking platform, providing users with a space to connect. Fetchr does not verify the legitimacy of tasks or guarantee task completion. 5.2 No Mediation Fetchr does not mediate disputes or claims arising between users. All agreements, communications, and transactions are the sole responsibility of the involved parties. 6. User Data Collection and Privacy 6.1 Location Data Collection and Use To provide more accurate services, we may obtain your location information through your IP address when you log in. This information will be used to display tasks relevant to your current location, match you with appropriate services, and enhance the user experience. We commit to using your location data only for the necessary purposes of providing the service and will not use it for unauthorized purposes. 6.2 Third-Party Payment Services We process payments through third-party payment platforms, such as Stripe. Please note that the payment process is managed by these third-party payment service providers and is subject to their privacy policies and terms. You should review their respective privacy policies when using these services. 6.3 Data Protection We are committed to taking reasonable security measures to protect your data, including location data and payment information. We do not share your personal information with any third parties unless required by law or necessary for providing services. 6.4 Cross-Border Data Transfers As Fetchr is a cross-national and cross-regional platform, you agree that your personal data may be transferred to different countries or regions, some of which may have different privacy protection laws than your country of residence. We will take appropriate measures to ensure the security of your data during this transfer. 6.5 User Control and Choice You can control the location information we collect by adjusting the app settings or device permissions. If you choose to disable location functionality, certain features of the app may not work properly. 6.6 Third-Party Payment Compliance To ensure transparency and compliance with Google Play policies, Fetchr’s payment functionality is fully handled by third-party payment service providers (such as Stripe). All payment-related transactions adhere to the following rules: 6.6.1 Purpose of Payment Functionality Fetchr’s payment functionality is solely intended for task matchmaking and completion purposes. It does not involve any unauthorized payment activities or charges. 6.6.2 Compliance with Google Play Billing Policies Any payments related to digital content, services, or virtual products offered within Fetchr strictly comply with Google Play’s billing policies and are processed through Google Play’s billing system. Payments for physical goods or services (e.g., repairs, cleaning, delivery) may be processed via third-party payment platforms in accordance with Google Play’s guidelines. 6.6.3 Payment Transparency During the payment process, users will be clearly informed of the third-party payment provider’s name and detailed charges before proceeding with the transaction. Links to the terms and privacy policies of the third-party payment service provider will be prominently displayed on the payment interface for users to review. 6.6.4 User Choice Users retain the right to choose their preferred payment method, provided it aligns with the policies governing the specific type of service or product being purchased. 6.6.5 Refund Policy In cases of payment failure, task cancellations, or other eligible scenarios, Fetchr will assist users in initiating refunds through the respective third-party payment service provider. 7. Hotfixes and App Modifications 7.1 Hotfixes To improve app performance, fix bugs, and enhance user experience, we may apply JavaScript and HTML hotfixes to modify certain app functions. We commit that these updates will not affect your personal data or privacy settings and will not alter your core usage experience. 7.2 Update Notifications We will provide appropriate notifications within the app regarding hotfixes. By continuing to use the app, you consent to accept these updates. 8. Disclaimer 8.1 Platform Liability Fetchr provides services "as is" without any warranties. We disclaim any liability for losses or damages resulting from user interactions, platform failures, or third-party actions. 8.2 Independent Responsibility By using Fetchr, users accept full responsibility for their actions and interactions, including verifying information and ensuring the legality of activities. 9. Modifications to Terms 9.1 Modifications FunRealm reserves the right to modify these Terms at any time. Changes will be communicated via platform notifications. Continued use of the service constitutes acceptance of the updated Terms. 10. Governing Law and Dispute Resolution 10.1 Applicable Law These Terms are governed by the local laws of the jurisdiction where the Fetchr platform operates or the user resides, as applicable. 10.2 Dispute Resolution Disputes arising from these Terms must first be resolved through amicable negotiations. Failing that, disputes will be submitted to the local arbitration institution in the jurisdiction of the user’s residence, or resolved through legal proceedings in accordance with local laws. 11.
